Terms & conditions for Onlineaquariumspullen

1. General
1.1 These terms and conditions apply to all offers of online aquarium supplies.

1.2 By placing an order you agree to the payment and delivery terms.
1.3 Online Aquarium Stuff guarantees that the product delivered meets the specifications listed on the website.

2. Delivery

4. Term View / right of withdrawal

5. Data

6. Warranty and conformity

10. Force Majeure

11. Liability

12. Retention

13. Billink / Klarna

Payments to Billink / Klarna B.V, established in Rotterdam, (hereafter: “Billink / Klarna”) need to be made within the agreed upon terms of payment. All rights relating to and stemming from this invoice and any related claims have been legally transferred to Billink / Klarna, whom will take it upon itself to collect all further receivables. The data as provided by you will be used by - or on behalf of – Billink / Klarna, for the purpose of - but is not limited to - collection purposes, review of specific orders and the execution of the individual acceptance policies by affiliated (credit)organizations.

Billink / Klarna reserves the right to refuse any request by its customer to pay on account. The agreed upon terms of payment serve as a final deadline. If the deadline is not met you will be in default without any further notice. If the terms of payment are not met, Billink / Klarna is entitled to charge a 0.75% monthly interest rate- whereby any part of a month is to be considered a full month. Billink / Klarna is also entitled by Dutch law to charge you with additional extrajudicial collection fees. If you are acting on behalf of a company or profession, Billink / Klarna is entitled to charge you reminder- and dunning fees, notwithstanding the right to charge you with the actual incurred costs, fees and damages, if exceeding the calculated amount. These fees amount to a minimum of 15 percent of the principal invoice with a 40 EURO minimum for consumer customers and a 75 EURO minimum for business customers. Billink / Klarna is entitled to assign the outstanding claim to a third party of choice for further collection purposes if there are no or insufficient receivables. All of the above stated rights in regards to Billink / Klarna will in that case be transferred to the third party.

14. Applicable law / jurisdiction
14.1 All agreements are subject to Dutch law.
14.2 Disputes arising from an agreement between online aquarium supplies and copper, which not be resolved by mutual agreement, the competent court within the district Drachten knowledge unless online aquarium stuff there prefer the dispute to the competent court of the domicile of the purchaser, and with the exception of those disputes that fall under the jurisdiction of a magistrate.
